Supplementary conditions for Santander hire purchase

1. scope of application and general information

##########_1__ The following Supplementary Terms and Conditions apply to contracts concluded between us and our customers in which the instalment purchase payment method is used. In the event of a conflict, these Supplementary Terms and Conditions shall take precedence over any other General Terms and Conditions.
1.2 Payment by instalments is only possible for customers who are consumers in accordance with § 13 BGB (German Civil Code) and have reached the age of 18.
1.3 The instalment purchase is provided in cooperation with Santander Consumer Bank AG ("Santander"), Santander-Platz 1, 41061 Mönchengladbach, Germany.

2. invoice / instalment purchase

With hire purchase, you decide to pay the purchase price in monthly instalments over a fixed agreed term (hire purchase), whereby the first monthly amount or the last monthly amount may differ from the other amounts.

3. instalment purchase terms, due date of monthly payments

With regard to the term of your instalment purchase, you can choose between different terms. The first monthly payment is due 30 days after the invoice date; all subsequent monthly payments are due on the corresponding calendar day of the following month (example: invoice date 08.04.2017, 1st instalment 08.05.2017, subsequent payments on the 8th of the following month).

4. assignment of claims, responsibility for customer enquiries and warranty

##########_6__ We would hereby like to inform you that the claims against you arising from the instalment purchase are assigned to Santander. Payments can only be made to Santander with debt-discharging effect.
##########_7__ The assignment does not change the responsibility for general customer enquiries (e.g. about goods, scope of services, delivery time or dispatch), returns, complaints or the processing of warranty claims; this remains with us as your contractual partner.

5. credit check, alternative payment methods

##########_8__ The payment method instalment purchase can only be offered after prior verification of your creditworthiness.
##########_9__ If the use of hire purchase is not possible due to insufficient creditworthiness or for other reasons, we will offer you an alternative payment option. You are free to conclude the contract using the alternative payment method offered or to cancel the order process.

6. warning: consequences of non-payment

6.1 If you do not fulfil your payment obligation or do not fulfil it in full within the payment period, you will be in default without any further reminder. We would like to point out that in the event of default, you are obliged to pay compensation for the damage caused by the default. The damage caused by default may include, in particular, costs for reminders and costs for appropriate legal action (e.g. lawyer's fees).
##########_11__ A fee of EUR 1.20 may be charged for each reminder. You have the right to prove that no damage has been incurred at all or not in this amount.
6.3 Incoming payments - if there are several claims against you - will be credited against the oldest debt.
##########_13__ Instalment payment contracts may be terminated in the event of default of payment under the following conditions:
- You are in arrears with at least two consecutive instalments in full or in part and with at least 10 percent of the nominal amount of the loan and
- You have been unsuccessfully set a two-week deadline for payment of the overdue amount with the declaration that the entire remaining debt will be demanded if payment is not made within the deadline.
##########_14__ The claims against you arising from the hire purchase may be assigned to third parties at any time, in particular to debt collection agencies for the purpose of collecting overdue amounts.

7. information on the right of cancellation for hire purchase contracts

Consumers generally have a statutory right of cancellation when concluding instalment transactions (hire purchase contracts), about which we provide information below.
Cancellation policy for instalment payment transactions
Right of cancellation
The instalment buyer may cancel his contractual declaration within 14 days without giving reasons. The period begins after conclusion of the instalment contract, but only after the instalment buyer or a third party named by the instalment buyer, who is not the carrier, has taken possession of the goods and not before the instalment buyer has received all mandatory information in accordance with Section 492 (2) BGB (e.g. information on the type of loan, information on the net loan amount, information on the contract term). The instalment buyer has received all mandatory information if it is contained in the copy of the contract deed intended for the instalment buyer or in a copy of his application or the contract deed intended for the instalment buyer and such a document has been made available to the instalment buyer. The instalment purchaser may be informed subsequently on a durable medium of any mandatory information not included in the text of the contract; the cancellation period shall then be one month. The instalment purchaser must be informed again of the start of the cancellation period with the subsequent mandatory information. To comply with the cancellation period, it is sufficient to send the cancellation in good time if the declaration is made on a durable medium (e.g. letter, fax, e-mail). The cancellation must be sent to:
[name/company]
[summonable address]
[fax no. or e-mail address if applicable]
Consequences of cancellation
If the instalment buyer cancels this instalment contract, the instalment seller must refund all payments received from the instalment buyer, including delivery costs (with the exception of additional costs resulting from the fact that the instalment buyer has chosen a different type of delivery than the cheapest standard delivery offered), without delay and at the latest within fourteen days of the day on which the instalment buyer cancels the contract. The instalment vendor shall refund all payments received from the instalment purchaser, including delivery costs (with the exception of additional costs resulting from the fact that the instalment purchaser has chosen a different type of delivery than the cheapest standard delivery offered), immediately and at the latest within fourteen days from the day on which the instalment vendor receives notification of the cancellation of the instalment contract. For this repayment, the instalment vendor shall use the same means of payment that the instalment purchaser used for the original transaction, unless expressly agreed otherwise with the instalment purchaser; under no circumstances shall the instalment purchaser be charged any fees for this repayment. The instalment vendor may refuse to make a refund until it has received the goods back or until the instalment purchaser has provided proof that it has returned the goods, whichever is the earliest.
The instalment purchaser must return or hand over the goods to the instalment vendor without delay and in any case within fourteen days at the latest from the day on which he informed the instalment vendor of the cancellation of this contract. The deadline is met if the instalment buyer dispatches the goods before the period of fourteen days has expired. The instalment buyer shall bear the direct costs of returning the goods. The instalment buyer shall only be liable for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.
